Website Terms of Use

1.a The terms with an uppercase have the following meanings:

Terms of Use: by the Dutch American Police Department Foundation (hereinafter DAPD) used terms of use;

Website: the website (s), including the home page (s) and child page (s) of DAPD

User: Each (group of) individual(s) and / or legal person(s), whether or not exercising any profession or business, in any form or by any means use the Website.

b. The in this Terms of Use for using the Website capitalized term has, as far as it is defined in paragraph a, the meaning that corresponds to the definition in that paragraph, unless otherwise expressly stated in these Terms of Use.

2. a. To all legal relationships arising out of, or who are related to the use of the Website, the Terms of Use are applicable.
b. Personal data are processed in accordance with the Dutch Data Protection Act.

3. Terms of Use exclude the applicability of the terms and conditions applied by the user. The exclusion provided in the preceding sentence shall also apply in cases where the user's conditions or terms stipulated priority.

4. Any liability regarding the use of the information on this website, images, sounds, or downloads is at all times entirely with the user.

5. Information on the Website is general in nature. No rights, how and in what form, are derived

6. DAPD is in no way liable or responsible for:

a-damages, for any reason whatsoever and in any form whatsoever, resulting from or related to the use of the Website;
b-the falsity and/or incompleteness of the content and/or information on the Website;
c-the, whether or not for your own use, reproduction and/or distribution and/or publishing and/or otherwise spreading of material provided by the Website and the information in itself on websites, texts, images and other expressions;
d-the content and/or information of (an) other website(s), even if in that Web site(s) is a reference to the Website and/or a link to the Website and/or otherwise is referred to the Website and/or otherwise provides access to the Website;
e-the content and/or information of (an) other website(s) referenced to in the Website and/or there is a link to that website and/or there is a reference in the Website and/or which is accessed via the Website;
f-damages, for any reason whatsoever and in any form whatsoever, resulting from your use of any means of communication (electronic) or the receipt of any message through any (electronic) communication channel;
g-damages, for any reason and in whatever form, resulting from a late, incorrect and/or incomplete transfer of the contents of a, through any means of communication and/or (electronic) communication system, or by user message, such as DAPD per e-mail;
h-the follow-up of opinions present on the Website;
i-pulling effects or conclusions from the information available on the Website and/or texts and/or images and/or other expressions;
j-information, texts, image material or any other expression that is placed and/or published on the Website without the written permission of DAPD.

7. User is responsible for taking measures against damage from any cause and in whatever form, that possibly may occur through the use of the Website.

8. DAPD has the copyright of the by the DAPD in and/or on the Website published text, images and other statements, unless otherwise indicated.

9. Without the consent of DAPD it is not permitted, with or without the aid of third, to use the information, text, images and other communications from the Website for reproduction and/or distribution and/or to publish and/or to provide otherwise, except:
a-for its own use, which explicitly doesn't mean exploiting the information on the Website, texts, images and other publications;
b-by the inclusion of a link in search engines, indexes, directories and other collection sites, excluding sites with a sexual and / or discriminatory and / or insulting and / or violence calling and / or hate calling and / or illegal content ;
c-through the inclusion of any reference, but only insofar DAPD did so express with written consent.

10. It is not permitted without the consent of DAPD to display the Website in a frame or otherwise make it part of any website.

11. DAPD is not liable for a fee for including a hyperlink or any other reference to the Website.

12. User indemnifies DAPD against all claims of third and all the related costs to be incurred by DAPD, which claims arising out of or are related to the use of the Website.

13.a. All legal relationships between DAPD and User is exclusively governed by Dutch law.
b. Disputes between DAPD and User shall be exclusively settled by the competent Dutch court. 
c. DAPD is not liable for claims resulting from bad translations

10. Het is zonder toestemming van DAPD niet toegestaan de Website in een frame te tonen dan wel op enige andere wijze onderdeel te maken van enige website.

 11. DAPD is geen vergoeding verschuldigd voor het opnemen van een hyperlink of enige andere verwijzing naar de Website.

 12. Gebruiker vrijwaart DAPD tegen alle aanspraken van een derde en de in verband daarmee door DAPD te maken kosten, welke aanspraken voortkomen uit of samenhangen met het gebruik van de Website.

 

13.a. Op alle rechtsbetrekkingen tussen DAPD en Gebruiker is uitsluitend Nederlands recht van toepassing.

 b. Geschillen tussen DAPD en Gebruiker zullen uitsluitend worden beslecht door de bevoegde Nederlandse rechter.
